Government, Governance and Democracy in Tanzania: The Functioning of the Three Branches of State in Tanzania, the Executive, Legislature and Judiciary

This Book is designed to inform readers and the general public in Tanzania and elsewhere on how the Government of Tanzania governs and manages democracy under multi-party-political system. In Tanzania, the Union Constitution which came into force in 1977 and several acts of Parliament, such as the Criminal Procedure Act, contain some clauses which prohibits bails to people suspected of committing unbailable offences. These clauses which deprive Tanzanians of their constitutional rights and stifle democracy have led to complaints and demands for reform. As such, the Union Constitution has come under scrutiny by human rights activists and the general public. Attempts by the State to reform the Union Constitution by appointing Reform or review commission have so far failed to bear positive results.In administering and governing the affairs of the State, the Government of Tanzania should focus on core functions of governance such as creating a conducive environment for the business to thrive; peace, defense and security; the rule of law; economic policy and management and overall supervision of implementation of affairs of the countryNormally, Civil services are normally seen as the pivotal engines on which administration of State matters hinges. In this regard, the Tanzania civil service has to be continuously reformed to be small, efficient, well remunerated and motivated. It should acquire new technologies, management systems and procedures, recruit qualified and skilled people to run the civil service to make it efficient and fulfill this requirement.Failure by some state institutions, such as the police, judiciary, Directorate of Public Prosecution (DPP), etc., to follow the in providing adequate and fair rights and justice to some Tanzanians, who appear before them, is shown by delays in making judgment by courts, police investigations, dismissal of cases by courts due to lack of evidences, fabrication of offences and evidences, among other things.Corruption is perceived to be rampant in many public institutions in Tanzania such as ministry of lands, health, local government authorities, police, judiciary, etc., which provide services to the people. Evidence of corruption is shown by annual reports of the Prevention and Combating Corruption Bureau (PCCB); Transparence International Annual International Perception Corruption Index and Afro-barometer annual reports. TI annual reports consistently show that Tanzania is one of corrupt countries in the world.Again, failure by the Government to reform or amend clauses in Constitution and several acts of parliament which deprive people of Tanzania their constitutional and legal rights, perpetuates the plight of the people of Tanzania.Because corruption deprives the people of Tanzania of their rights, the state should reform Constitution and acts of Parliament by repealing punitive clauses, which deprive people of Tanzania of their constitutional and legal rights. Also, the Government should prevent and fight corruption in the country by enforcing strictly anticorruption legislations and strategies.The book describes governance and democracy by the government of Tanzania. These are carried out by the executive, legislature and judiciary. It is left to the reader to decide whether or not they meet expected standards.After graduation from the University, he was employed in the Civil Service by the Government of Tanzania. While working, earned Government scholarships to study M.A. and M.Sc. degrees in public administration and Management at Westminster University in UK and Arthur De Little Management Institute in USA. He rose to the senior most position, of permanent secretary in the Civil Service. He acquired a wide experience on how the Government of Tanzania governs.
